| BRIEF DESCRIPTION OF AGENDA ITEM AND REQUESTED BOARD ACTION: |
| Discussion/approval/disapproval of Lease Agreement between Pinal County (Landlord) and New Cingular Wireless PCS, LLC, a Delaware limited liability company (Tenant) located in the northwest quarter of Section 32, Township 1 South, Range 13 East of the Gila and Salt River Meridian, Pinal County, Arizona. Lessee desires to enter a lease for implementation of the Nationwide Public Safety Broadband Network (“FirstNet”), and not for commercial purposes. This lease will commence on December 21, 2022 for an initial term of 10 years with three 5-year automatic renewals. The monthly rent amount shall be $2,400.00 with an annual 2% increase. This lease is subject to third-party approval by Resolution Copper Mining, LLC. The acceptance also requires an amendment to the FY 22/23 budget to transfer reserve appropriation only from Fund 213 (Grants/Project Contingency) to Fund 10 (GF - Public Works) to increase revenue and expenditure appropriations. The appropriation is a pro-rated amount of $16,800 for the current fiscal year. The remaining amount will be budgeted in FY 23/24. This item requires unanimous consent of the Board.
